1. General
Terms
1.1 We reserve the right to change
these terms and conditions at any time. Any such changes will take effect
when posted on the website and it is your responsibility to read the terms
and conditions on each occasion you use this website and your continued
use of the website shall signify your acceptance to be bound by the latest
terms and conditions.
1.2 Bargain Buggies is part of
Amalaika Ltd. We do not use our merchant account for transactions which
are part of Amalaika Ltd and hence payment should be made by paypal,
nochex, cheque, bank transfer, postal order or cash on collection.
1.3
Due to the nature of used pushchairs
they will not be like new. We try to be as honest in our descriptions as
possible since we want you to know what you are getting, have no nasty
surprises and be happy with your purchase. Used pushchairs often have the
odd mark or scratch because, obviously, they have been used! If you prefer
to not have these traits you may prefer to buy a new pushchair elsewhere
1.4 In the event that an item
ordered is not available we
will offer you a full refund or a credit of a higher value towards another
item belonging to Bargain Buggies or any of our other businesses if you
prefer
1.5 We accept no liability for
anything advertised but not sold by ourselves. The contract will be
between the advertiser and their buyer. All advertisers must pre-pay for
their advertising before their advert is displayed. We reserve the right
to remove any advert at any time and refund on a pro-rata basis if
applicable
1.6 I also list pushchairs bought for
my own personal use but no longer needed on this website.
2. Ordering
2.1 Please see the Order page for
information on how to place an order. All orders that you place on this
website will be subject to acceptance in accordance with these terms and
conditions.
2.2 On placing an order you should
receive a copy of your order with order number via email. Please keep this safe.
Please note that this e-mail is not an order confirmation or order
acceptance from us
2.3 Acceptance of your order and
the completion of the contract between you and us will take place on
dispatch to you of the products ordered unless we have notified you that
we do not accept your order or you have cancelled it (please refer to
Returns and refunds).
3.
Delivery
3.1 We deliver to Mainland
UK. We can also send to Highland UK and the Islands plus Western Europe
for a small additional fee. Purchases can be collected from us or from
Windsor by arrangement with payment on collection.
3.2 Delivery
is by courier. We send via a
trackable means with insurance. Courier delivery is arranged by us but
should you wish to arrange your own courier this may be possible but
packaging and handling costs will be due to cover our costs.
3.3 Risk of loss and damage of
items passes to you on the date when the products are delivered or on the
date of first attempted delivery by us.
3.5 If a parcel is returned to us
for any reason - eg not collected or unable to be delivered - then we can
resend to you if further postage is paid by you. This will be for the
exact amount it costs to send. If you would prefer a refund then postage
costs will be deducted from the refund as per our refund policy - ie at
cost price to us
3.6 We accept no responsibility for
the amount of time the courier takes to deliver your order once sent. Courier
delivery is Monday to Friday and you may specify a preferred delivery
date. We can not guarantee this but there is a 97% chance it will arrive
in this date. We can offer Saturday delivery for an additional postage
charge. All goods must be signed for on receipt
We make every effort to send goods within a week of receiving your order. Delays such as holidays will
be noted on the website. Delays are occasionally inevitable due to
unforeseen factors. We shall be under no liability for any delay or
failure to deliver the products within estimated timescales.
3.7 We deliver to the address given by you when placing the order. We take
no responsibility for missing parcels if the address you gave is incorrect
4. Payment
4.1 Goods are subject to availability. In
the event that we are unable to supply the items, we will inform you of
this as soon as possible. A full refund will be given where you have
already paid for the goods.
4.2 The price you pay is the price
displayed on this website at the time we receive your order. The following
exception applies: While we try and ensure that all prices on our website
are accurate, errors may occur. If we discover an error in the price of
goods you have ordered we will inform you as soon as possible and give you
the option of reconfirming your order at the correct price or cancelling
it. If we are unable to contact you we will treat the order as cancelled.
If you cancel and you have already paid for the goods, you will receive a
full refund. Likewise, if postage is miscalculated due to selection the
wrong country of residence at registration we will give you the option of
paying the correct amount of postage or of cancelling your order
4.3 Payment can be made by any
method specified here - Paypal, Nochex, cash (-GBP, Euros
or US$), Postal Order, Bank Transfer or cheque. Debit card by arrangement
4.4 Title to any products you order
on this website shall pass to you on delivery of the products provided
that we have processed and received payment in full for the products.
4.5 All prices include VAT (where
applicable) at the applicable current rates but exclude delivery charges,
unless stated otherwise
5. Returns,
cancellations
5.1 We offer a money back
guarantee for online orders as long as you contact us in writing during these 7 days to
arrange a return and as long as the item has not been used by you. We comply with the Distance Selling
Regulations. Return postage is at your expense and we advise ensuring it
is insured. We are able to arrange return of larger items via courier at a
cost of £15 per package. Packaging must be paid for by yourselves and all
goods must be correctly packaged to avoid damage in transit. You will be
liable for any damage caused in transit due to incorrect packaging. Refunds will be made within 30 days. If you have not returned
the goods by this time we can send a courier to collect the goods at your
expense.
5.2 All sizes and measurements, if
listed, are approximate but we do try to make sure that they are as
accurate as possible but please remember these are second-hand goods and
not new.
5.3 Should you wish to return an
item ordered online please contact us in writing (email or letter) before doing so within
7 working days following receipt of the item. Items must be returned in
the condition in which they were sent, unused, free of smoke smells, pet
hairs or stains. Items that are returned in an unfit or used-by-you state will not be
accepted. Items remain your property until they reach us safely so it is
up to you to ensure they are adequately insured. We are able to
arrange courier collection from you on a day to suit and the cost of this
will be deducted from any refund.
5.5 Please bear in mind that we are a small low profit
making company and relisting items is very time consuming. It is always
better to email us with any questions about an item before ordering. We
don't mind, won't bite and are quite friendly really!
5.7 If you wish you return
an unused-by-you item outside the 7 day guarantee period then please contact us
first. If we agree to a return you will be issued with a store credit for
the net value of the returned item for use on any of our websites. Postage is payable on subsequent
orders if the gross order value comes to more than the credit amount.

6. Misc
6.1 The contract between us shall
be governed by the laws of England and any dispute between us will be
resolved exclusively in the courts of England. English is the only
language offered for the conclusion of the contract.
6.2 We shall be under no liability
for any delay or failure to deliver products or otherwise perform any
obligation as specified in these terms and conditions if the same is
wholly or partly caused whether directly or indirectly by circumstances
beyond its reasonable control.
6.3 To provide increased value to
our customers, we may provide links to other websites or resources for you
to access at your sole discretion. You acknowledge and agree that, as you
have chosen to enter the linked website we are not responsible for the
availability of such external sites or resources, and do not review or
endorse and are not responsible or liable, directly or indirectly, for (i)
the privacy practices of such websites, (ii) the content of such websites,
including (without limitation) any advertising, content, products, goods
or other materials or services on or available from such websites or
resources or (iii) the use to which others make of these websites or
resources, nor for any damage, loss or offence caused or alleged to be
caused by, or in connection with, the use of or reliance on any such
advertising, content, products, goods or other materials or services
available on such external websites or resources. 6.4
No variations to these Terms and
Conditions will be accepted without agreement in writing.
6.5 All pushchairs must be used
in accordance of the safety notes supplied on the hire page (see
here). We are not responsible for any damage caused by your failure
to follow these safety instructions. This applied to both sale and hire
of our products
7. Hire/Rental
of our pushchairs or equipment 7.1
We (Bargain Buggies) agree to hire the buggy to you (The Hirer) subject to
availability and as specified at booking at the price agreed. Payment of
the full hire cost together with a refundable deposit must be made on
collection or prior to delivery by an agreed method of payment unless
otherwise arranged. 7.2
Return of the pushchair must be on the agreed date. If you wish to extend
the rental period please contact us before the return date to see if this
is possible and to agree on additional rental costs. If you fail to return
the pushchair/item on the agreed date and have no agreement in place for
extension of the rental period then a charge of £10 a day will be due.
This will be deducted from the deposit. If the item is due out to another
customer and we have to cancel their booking or sale then we will invoice
you for any consequential loss suffered due to failure to return the item
on time. 7.3
If the pushchair is to be sent and returned by courier then these costs
will be payable by yourself at the agreed rate. To return by courier
please contact us before the end of the rental period to confirm return
details. We arrange the courier for you. The courier will call between 9am
and 6pm but we can not specify an exact collection time.
If you are returning in person please contact us before the return date to
agree a return time if this has not been pre-arranged 7.4
It is advisable that you have personal insurance to cover any damage or
loss to the pushchair. Should the pushchair be damaged or lost whilst in
your care then you will be responsible for the repair costs or replacement
costs . Replacement costs will be based on the price we would sell the
pushchair for in the condition it was in at the start of the rental
period. If you damage the pushchair or lose any part you may replace the
part yourself provided that the replacement is not of a lesser standard
and condition. You have full responsibility for the care and safekeeping
of the equipment. You are responsible for ensuring that it is used in a
safe and sensible manner, used only for the purpose for which it is
supplied and in accordance with the manufacturer's instructions and you
shall provide supervision where appropriate. The Hirer will pay to
the Supplier all costs incurred by the Supplier rectifying the condition
of any Equipment returned damaged or unclean. Additionally, the Hirer
will pay to the Supplier a charge equalling to the financial loss of the
Supplier until such rectification is complete. 7.5
Please check the pushchair on receipt and notify us of any damage not
noted in our checklist within 24 hours if applicable. If collecting in
person any damage will be noted by us and agreed by you prior to the
rental period and the pushchair checked on return. 7.6
All our pushchairs are security marked and these markings will be checked
on return. If the pushchair is returned in an unclean state a charge of
£10 will be deducted from the deposit to cover cleaning costs 7.7
We cannot accept responsibility for any failure or delay on our part to
fulfill our obligations where such failure/delay is caused by
circumstances beyond our control. 7.8
We shall not be liable for any consequential loss to the Hirer including
any expenses, liability, loss, claim or proceeding whatsoever caused by or
arising out of the late delivery, non-delivery, unsuitability or lawful
repossession of the Equipment, or any part thereof, or any breakdown or
stoppage of same. Nothing in this clause shall affect statutory
rights of a person dealing as a consumer as defined by the Unfair
Contracts Terms Act 1977. 7.9
Instructions will be supplied with all equipment, where these have been
supplied by the manufacturer, and these shall be read carefully prior to
using the equipment and strictly adhered to whilst using the equipment 7.10 If a problem develops during
the hire period we will endevour to sort the problem as soon as possible.
This may be by replacing the pushchair for a similar one. If you prefer a
refund can be given on a pro-rata basis.
7.11 All pushchairs hired
by us may not be used to transport anything other than babies or children.
You must ensure that any children placed in the pushchair do not exceed
the max weight limit for that pushchair (we will advise on the time of
rental if you tell us the age and weight of the child/ren who will use the
pushchair) and that any shopping placed in the shopping basket/s do not
exceed the max weight for that pushchair. Any damage caused by you due to
your failure to follow these safety instructions will be payable within 7
days of return of the pushchair. |
